(b) The commission shall adopt rules for the reactivation of a retired peace officer's license after a break in employment. The program must require intra-agency posting of all positions concurrently with any public posting. (b) The amount of the penalty shall be based on: (2) the respondent's history of violations; (3) the amount necessary to deter future violations; (4) efforts made by the respondent to correct the violation; and. (a) Before a law enforcement agency may hire a person licensed under this chapter, the agency must, on a form and in the manner prescribed by the commission: (1) obtain the person's written consent for the agency to review the information required to be reviewed under this section; (2) request from the commission and any other applicable person information required to be reviewed under this section; and. 545), Sec. 7, eff. 2445), Sec. (b) A person who is disqualified by law to be an officer or county jailer may not enroll in a training program described by Subsection (a). Sec. (c) The training program shall include 80 hours of instruction designed to: (1) emphasize strategies for preventing school shootings and for securing the safety of potential victims of school shootings; (2) educate a trainee about legal issues relating to the duties of peace officers and the use of force or deadly force in the protection of others; (3) introduce the trainee to effective law enforcement strategies and techniques; (4) improve the trainee's proficiency with a handgun; and. A Peace Officer has the responsibility to uphold the peace. The commission's rules shall require recommendations from an elected official of this state or a political subdivision, an administrator of a law enforcement agency, or a person holding a license issued by the commission. (B) before completing 10 years of cumulative service as a commissioned officer with one or more state or local law enforcement agencies, separated from employment with the agency or agencies and is a qualified retired law enforcement officer; (2) the officer's license as a commissioned officer was not revoked or suspended for any period during the officer's term of service as a commissioned officer; and. Sec. The commission by rule shall set 21 years of age as the minimum age for obtaining a license as an officer. 324 (S.B. (l) As a requirement for an intermediate or advanced proficiency certificate issued by the commission on or after January 1, 2016, an officer must complete the canine encounter training program established by the commission under Section 1701.261. ), if: (1) the person is an officer, employee, or paid consultant of a Texas trade association in the field of law enforcement or county corrections; or. (c)The actor is presumed to have known that the peace officer, federal special investigator, (a) The law enforcement officer standards and education fund account is in the general revenue fund. (b-1) The commission shall issue a certificate of proficiency to a qualified retired law enforcement officer who: (1) satisfactorily demonstrates weapons proficiency to a qualified handgun instructor under Subsection (b-2); (2) provides to the commission a sworn affidavit stating that: (A) the officer meets the requirements for a qualified retired law enforcement officer under 18 U.S.C. 399 (S.B. (3) a request or multiple requests from the same person in a 24-hour period for body worn camera recordings that, taken together, constitute more than five total hours of video footage. (1)a felony of the third degree, if the defendant took a weapon described by Subsection Our courses are designed by Subject Matter Experts who are nationally recognized and licensed instructors. Sec. 1.05, eff. Section 201 et seq. (4) establishes sanctions for failing to comply with an audit request or to correct a violation found during the audit process. 1701.624. TRAINING FOR SCHOOL DISTRICT PEACE OFFICERS AND SCHOOL RESOURCE OFFICERS. September 1, 2021. The request must be accompanied, in accordance with commission rules, by evidence of satisfactory completion of an accredited telecommunicator training program. (b) A policy described by Subsection (a) must ensure that a body worn camera is activated only for a law enforcement purpose and must include: (1) guidelines for when a peace officer should activate a camera or discontinue a recording currently in progress, considering the need for privacy in certain situations and at certain locations; (2) provisions relating to data retention, including a provision requiring the retention of video for a minimum period of 90 days; (3) provisions relating to storage of video and audio, creation of backup copies of the video and audio, and maintenance of data security; (4) provisions relating to the collection of a body worn camera, including the applicable video and audio recorded by the camera, as evidence; (5) guidelines for public access, through open records requests, to recordings that are public information; (6) provisions entitling an officer to access any recording of an incident involving the officer before the officer is required to make a statement about the incident; (7) procedures for supervisory or internal review; and. January 1, 2014. (2) any other personnel who will come into contact with video and audio data obtained from the use of body worn cameras. 1701.301. 1, eff. (f) The commission shall license a person who is eligible for appointment as a school marshal who: (1) completes training under this section to the satisfaction of the commission staff; and. (a) The commission and the Texas Department of Criminal Justice by rule shall adopt a memorandum of understanding that establishes each agency's respective responsibilities in developing a basic training program in the use of firearms by community supervision and corrections department officers and parole officers. A law enforcement agency may accept gifts, grants, donations, and federal and local money to implement this subchapter. Sec. 399, Sec. (2) are primary responders who respond directly to calls for assistance from the public. (a) A person dissatisfied with an action of the commission may appeal the action under Chapter 2001, Government Code. The presiding officer shall then notify the governor and the attorney general that a potential ground for removal exists. (b) The rules adopted under this section must require that an applicant submit to the commission a high school transcript that indicates the applicant earned an endorsement in the public services category, as described by Section 28.025(c-1), Education Code. (3) submit to the commission confirmation that the agency, to the best of the agency's ability before hiring the person: (A) contacted each entity or individual necessary to obtain the information required to be reviewed under this section; and. 1, eff. 399 (S.B. 2, eff. The following are peace officers:(1) sheriffs, their deputies, and those reserve deputies who hold a permanent peace officer license issued under Chapter 1701, Occupations Code;(2) constables, deputy constables, and those reserve deputy constables who hold a permanent peace officer license issued under Chapter 1701, Occupations Code;(3) marshals or police officers of an incorporated city, town, or village, and those reserve municipal police officers who hold a permanent peace officer license issued under Chapter 1701, Occupations Code;(4) rangers, officers, and members of the reserve officer corps commissioned by the Public Safety Commission and the Director of the Department of Public Safety;(5) investigators of the district attorneys, criminal district attorneys, and county attorneys offices;(6) law enforcement agents of the Texas Alcoholic Beverage Commission;(7) each member of an arson investigating unit commissioned by a city, a county, or the state;(8) officers commissioned under Section 37.081, Education Code, or Subchapter E, Chapter 51, Education Code;(9) officers commissioned by the General Services Commission;(10) law enforcement officers commissioned by the Parks and Wildlife Commission;(11) officers commissioned under Chapter 23, Transportation Code;(12) municipal park and recreational patrolmen and security officers;(13) security officers and investigators commissioned as peace officers by the comptroller;(14) officers commissioned by a water control and improvement district under Section 49.216, Water Code;(15) officers commissioned by a board of trustees under Chapter 54, Transportation Code;(16) investigators commissioned by the Texas Medical Board;(17) officers commissioned by:(A) the board of managers of the Dallas County Hospital District, the Tarrant County Hospital District, the Bexar County Hospital District, or the El Paso County Hospital District under Section 281.057, Health and Safety Code;(B) the board of directors of the Ector County Hospital District under Section 1024.117, Special District Local Laws Code;(C) the board of directors of the Midland County Hospital District of Midland County, Texas, under Section 1061.121, Special District Local Laws Code; and(D) the board of hospital managers of the Lubbock County Hospital District of Lubbock County, Texas, under Section 1053.113, Special District Local Laws Code;(18) county park rangers commissioned under Subchapter E, Chapter 351, Local Government Code;(19) investigators employed by the Texas Racing Commission;(20) officers commissioned under Chapter 554, Occupations Code;(21) officers commissioned by the governing body of a metropolitan rapid transit authority under Section 451.108, Transportation Code, or by a regional transportation authority under Section 452.110, Transportation Code;(22) investigators commissioned by the attorney general under Section 402.009, Government Code;(23) security officers and investigators commissioned as peace officers under Chapter 466, Government Code;(24) officers appointed by an appellate court under Subchapter F, Chapter 53, Government Code;(25) officers commissioned by the state fire marshal under Chapter 417, Government Code;(26) an investigator commissioned by the commissioner of insurance under Section 701.104, Insurance Code;(27) apprehension specialists and inspectors general commissioned by the Texas Juvenile Justice Department as officers under Sections 242.102 and 243.052, Human Resources Code;(28) officers appointed by the inspector general of the Texas Department of Criminal Justice under Section 493.019, Government Code;(29) investigators commissioned by the Texas Commission on Law Enforcement under Section 1701.160, Occupations Code;(30) commission investigators commissioned by the Texas Private Security Board under Section 1702.061, Occupations Code;(31) the fire marshal and any officers, inspectors, or investigators commissioned by an emergency services district under Chapter 775, Health and Safety Code;(32) officers commissioned by the State Board of Dental Examiners under Section 254.013, Occupations Code, subject to the limitations imposed by that section;(33) investigators commissioned by the Texas Juvenile Justice Department as officers under Section 221.011, Human Resources Code; and(34) the fire marshal and any related officers, inspectors, or investigators commissioned by a county under Subchapter B, Chapter 352, Local Government Code.
